1. All submissions to the Court must be accompanied by a detailed cover letter, a copy of the petition/motion, and proposed order.

2. If all parties are represented, submissions may be done by email. If any parties are unrepresented (pro se) then submissions must be done by USPS/FedEx/UPS and include copies to conform along with SASEs.

3.Scheduling is done by email only. Submit a request to the JA to ClaxtonK@clayclerk.com and include the case style, case number, what is being set for hearing, what date it can be found on the docket, and how much time is requested.

4. Phone appearances are never permitted in foreclosure hearings, pretrial conferences, status conferences, or case management conferences.

5. For Motions to Set the movant must appear in person for scheduling. All other counsel may appear telephonically. If there is more than one, you must conference yourselves together prior to calling in. A Motion to Appear Telephonically is not required. In the event the movant cannot appear in person, he/she can see if opposing counsel would be willing to attend in person in his/her place.

6. A Motion to Appear Telephonically is required for all hearings where phone appearances are permitted (except #5). It must be filed and delivered to Judge Wilkinson a minimum of 72 business hours in advance or it will be DENIED!

7. Ex parte is for uncontested matters and motions to set. All other matters must be cleared with the Judicial Assistant. Ex parte dates and times may be found at /ex-parte-dates-division-f/. It is highly recommended that ex parte dates be confirmed with the JA as they are subject to change or be cancelled.

8. A checklist for uncontested dissolutions of marriage must be completed prior to the hearing. The form may be found at Checklist for Uncontested Dissolutions.

9. Pretrial stipulations for both family and civil may be found at Pretrial Stipulation (Dissolution). The forms on the website will be the only versions accepted. They must be filled out completely prior to the hearing.

10. Trial set memos for both family and civil may be found at Trial Set Memo (Family) . The forms on the website will be the only versions accepted. They must be filled out completely prior to the hearing.

11. Any hearing over one (1) hour requires a Motion to Set.

12. All temporary needs motions will be referred to the General Magistrate for hearing.

13. A Positive Divorce Resolution (PDR) Course is required to be completed by both parties in both Dissolution of Marriage and Paternity cases. Online courses will not be accepted unless with prior permission from the Court.

Emergency Motions

Emergency Motions may be faxed or emailed to the Judicial Assistant for the Judge’s review. The Judicial Assistant will contact the attorney for the moving party to notify them whether the Motion will be heard on an emergency basis or will be heard on the next available time of the regular court calendar. There will be no Ex-Parte communication concerning emergency motions.
